In order to implement a phased transition from the use and sale of polyethylene packaging of goods to the use of environmentally safe paper packaging, the Ministry of Antimonopoly Regulation and Trade of the Republic of Belarus adopted Resolution No. 72 dated September 2, 2019 "On Amending the Resolution of the Ministry of Antimonopoly Regulation and Trade of the Republic of Belarus dated June 27, 2017. No. 28" (hereinafter referred to as Resolution No. 72), which provides for the presence in trade facilities of paper bags (bags), disposable tableware and paper cutlery for sale to the public, namely: Paper bags and disposable tableware and cutlery made of paper are included in Resolution No. 72 as goods sold to customers.; The availability of paper bags (as free packaging materials) is not a requirement of Resolution No. 72; if the trade entity does not sell such goods as bags, then it has no obligations to sell paper bags. For reference: In accordance with the Law of the Republic of Belarus dated January 8, 2014. No. 130-Z "On State Regulation of Trade and public Catering in the Republic of Belarus" a trade entity independently determines the range of goods offered for sale, and then includes them in the assortment list of goods for its retail outlet, depending on its type and type, the availability of retail space and its size, the classes and (or) groups sold., types of goods with an indication of the number of their varieties from the corresponding list of goods to be included by trade entities in the assortment list of goods, established by the Resolution of the Ministry of Antimonopoly Regulation and Trade of the Republic of Belarus dated June 27, 2017 No. 28 "On Lists of goods". Taking into account the fact that Resolution No. 72 entered into force after its official publication, it was decided at the working meeting that MARCH would monitor the implementation of Resolution No. 72 for 2 months without the application of penalties, during which time the trade should ensure strict enforcement of this resolution. For reference: The absence of goods on sale provided for in the assortment lists of goods is a violation of the rules of trade, which entails administrative liability in accordance with Article 12.17 of the Administrative Code (a fine of up to 10 basic units, repeated within one year of a similar violation – a fine of 10 to 30 basic units).
